As a Wage and Hour Division Enforcement Officer

Morris's Wage and Hour Division career involved the enforcement of FLSA and other Wage and Hour Division laws. He developed evidence; established the application of relevant regulations to the factual circumstances; made determinations of coverage, exemptions, and status of compliance; and computed or supervised the computation of back wages. He was very technically oriented throughout his DOL career, and consistently attempted to apply the statutes correctly (based on regulatory guidance and research of other reference sources). Morris worked closely with DOL attorneys in litigation, debarment, and penalty-appeal cases (developed and evaluated evidence, made recommendations to attorneys, assisted attorneys in trial preparation and settlement conferences, and testified as a factual and expert witness).

Enforcement experience in three Wage and Hour District Offices afforded Morris the opportunity to conduct investigations over a broad spectrum of industries.  

Thousands of exemption classification issues were resolved, including executive, administrative, professional, computer professional, and outside sales. Examples of other FLSA monetary exemptions that were evaluated as a part of the enforcement procedures were seasonal recreational and amusement establishments, retail establishment employees paid on a commission basis, agriculture, certain employees of auto/truck/RV/farm implement/boat/mobile home dealers, safety-affecting employees of motor carriers, and domestic employment (casual baby sitting, companion to an aged or ill person, and live-in domestic employees).


Morris is very experienced in the enforcement of FLSA standards applicable to state and local government and, therefore, knowledgeable of how FLSA provisions apply to public agencies and institutions. Investigations were conducted of state agencies, counties, municipalities, and publicly-operated institutions of higher education. His experience is particularly extensive with respect to sections 7(k) and 13(b)(20) (fire, police, corrections, EMS). Much of his FMLA experience was also in public agency cases.


Enforcement and outreach involving public school districts enabled Morris to gain much experience and insight with regard to their practices that are often in conflict with FLSA obligations. He spoke at meetings of school district superintendents and other public school district managers to present information about FLSA, and to answer questions. School district enforcement included investigations and litigation.


Morris worked cases involving government contractors throughout his enforcement career. He is very familiar with the provisions of regulations that are relevant to federal service and construction contracting labor standards. He knows from first-hand experience the common practices that cause violations of these laws. Experience as a Consultant


Upon retirement from DOL/Wage and Hour Division on June 3, 2000, Morris established his highly-focused and specialized consulting practice.
